Some Basics On Cosmetic Registration In Malaysia

The laws in Malaysia require all cosmetic products to be registered before being marketed to the public with the National Pharmaceutical Regulatory Agency (NPRA), which is a governance body under Malaysia’s Ministry of Health (MOH), also known as Kementerian Kesihatan Malaysia (KKM) in Malay.

1. Why Is Cosmetic Notification Necessary?

The notification is necessary to do, as this allows NPRA to ensure that the cosmetic products meet all regulatory guidelines prior to marketing and subsequent circulation in the market.

It is of utmost importance to note that it is illegal to manufacture and then try to sell cosmetic products that have not been registered with NPRA, which means that you will face legal consequences if you do not comply.

2. Who Is Responsible To Notify NPRA?

It is also necessary to consider the requirements of notification with NPRA as well. Simply put, the person or firm wishing to sell the cosmetic products must notify the agency, but if those in question do not own the rights to the products, then NPRA will require a letter of authorization allowing the person or company to market/sell the product.

This authorization, if needed, is an essential document without which processing the registration will not be possible. Furthermore, if it is a company that is applying for the registration, then it also needs to register itself with Syarikat Suruhanjaya Malaysia (SSM) or Malaysian Registrar of Business (ROB).

3. What Happens Immediately After Notification?

Approximately one to three days after you have notified and made payment with NPRA, you will receive a notification number (NOT) as well as a notification note. This note will act as the authorization of manufacturing, marketing and then selling of the cosmetic products.

The notification shall be valid for 2 years and renewal should be done no later than 1 month prior to expiry. This is to ensure that your timeline is not disturbed and your business does not have any unnecessary hurdles.

How Does NPRA Define Cosmetic Products?

For registration purposes, it is also important to understand which products fall within the constraints of cosmetics, as opposed to other products such as health supplements, natural products, pharmaceutical products, and others.

NPRA defines cosmetic products as “any substance or preparation intended to be placed in contact with various external parts of the human body (epidermis, hair system, nails, lips, and external genital organs) or with teeth and the mucous membranes of the oral cavity, with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance and/or correcting body odors and/or protecting them or keeping them in good condition”.

This definition of cosmetic products differentiates them from pharmaceutical or natural products, for example. Such differences make the difference between how long it takes to process a registration application for a particular product, as well as the type of documents required to make it happen swiftly.
